Inleiding
Hieronder vindt u onze Algemene Voorwaarden. Deze zijn steeds van toepassing als u gebruik maakt van of een bestelling plaatst via onze Website. De Algemene Voorwaarden bevat belangrijke informatie voor u als koper. Lees deze daarom goed door. Wij raden u verder aan deze voorwaarden op te slaan of af te drukken, zodat u ze op een later moment nog eens kunt teruglezen.
Artikel 1. Definities
1.1. SØSSA / Sussa Designs: gevestigd te Hoeven en ingeschreven bij de Kamer van Koophandel onder registratienummer 85725048 handelend onder de naam SØSSA / Sussa Designs.
1.2. Website: de website van SØSSA / Sussa Designs, te raadplegen via www.sossashop.com en alle bijbehorende subdomeinen.
1.3. Klant: de natuurlijke persoon die niet handelend in uitoefening van beroep of bedrijf een Overeenkomst aangaat met SØSSA / Sussa Designs en/of zich geregistreerd heeft op de Website.
1.4. Overeenkomst: iedere afspraak of overeenkomst tussen SØSSA / Sussa Designs en Klant, van welke overeenkomst de Algemene Voorwaarden integraal onderdeel uitmaken.
1.5. Algemene Voorwaarden: de onderhavige Algemene Voorwaarden.
Artikel 2. Toepasselijk Algemene Voorwaarden
2.1. Op alle aanbiedingen, Overeenkomsten en leveringen van SØSSA / Sussa Designs zijn de Algemene Voorwaarden van toepassing, tenzij uitdrukkelijk schriftelijk anders is overeengekomen.
2.2. Indien Klant in zijn opdracht, bevestiging of mededeling inhoudende aanvaarding bepalingen of voorwaarden opneemt die afwijken van, of niet voorkomen in de Algemene Voorwaarden, zijn deze voor SØSSA / Sussa Designs slechts bindend, indien en voor zover deze door SØSSA / Sussa Designs uitdrukkelijk schriftelijk zijn aanvaard.
2.3. Voor het geval dat naast deze Algemene Voorwaarden tevens specifieke product- of dienstenvoorwaarden van toepassing zijn, zijn die voorwaarden ook van toepassing, maar kan Klant zich in geval van tegenstrijdige voorwaarden steeds beroepen op de toepasselijke bepaling die voor hem het meest gunstig is.
Artikel 3. Prijzen en informatie
3.1. Alle op de Website en in andere van SØSSA / Sussa Designs afkomstige materialen vermelde prijzen zijn inclusief btw en, tenzij op de Website anders vermeld, andere heffingen welke van overheidswege worden opgelegd.
3.2. Indien er verzendkosten worden gerekend, zal dit duidelijk, tijdig voor het sluiten van de Overeenkomst worden vermeld. Daarnaast zullen deze kosten in het bestelproces apart worden weergegeven.
3.3. De inhoud van de Website is met de grootste zorgvuldigheid samengesteld. SØSSA / Sussa Designs kan echter niet garanderen dat alle informatie op de Website te allen tijde juist en volledig is. Alle prijzen en overige informatie op de Website en in andere van SØSSA / Sussa Designs afkomstige materialen zijn dan ook onder voorbehoud van kennelijke programmeer- en typefouten.
3.4. SØSSA / Sussa Designs kan niet verantwoordelijk worden gehouden voor (kleur)afwijkingen ten gevolge van beeldschermkwaliteit.
Artikel 4. Totstandkoming Overeenkomst
4.1. De Overeenkomst komt tot stand op het moment van aanvaarding door de Klant van het aanbod van SØSSA / Sussa Designs en het voldoen aan de daarbij door SØSSA / Sussa Designs gestelde voorwaarden.
4.2. Indien Klant het aanbod via elektronische weg heeft aanvaard, bevestigt SØSSA / Sussa Designs onverwijld langs elektronische weg de ontvangst van de aanvaarding van het aanbod. Zolang de ontvangst van deze aanvaarding niet is bevestigd, heeft de Klant de mogelijkheid de Overeenkomst te ontbinden.
4.3. Indien blijkt dat bij de aanvaarding of op andere wijze aangaan van de Overeenkomst door Klant onjuiste gegevens zijn verstrekt, heeft SØSSA / Sussa Designs het recht om pas aan haar verplichting te voldoen nadat de juiste gegevens zijn ontvangen.
4.4. SØSSA / Sussa Designs kan zich binnen wettelijke kaders op de hoogte stellen of Klant aan zijn betalingsverplichtingen kan voldoen, maar ook van alle feiten en factoren die van belang zijn voor een verantwoord aangaan van de Overeenkomst. Indien SØSSA / Sussa Designs op grond van dit onderzoek goede gronden heeft om de Overeenkomst niet aan te gaan, is hij gerechtigd om gemotiveerd een bestelling of aanvraag te weigeren of aan de uitvoering bijzondere voorwaarden, zoals vooruitbetaling te verbinden.
Artikel 5. Registratie
5.1. Om optimaal gebruik te maken van de Website, kan Klant zich registreren via het registratieformulier/ de account-aanmeldmogelijkheid op de Website.
5.2. Tijdens de registratieprocedure kiest Klant een gebruikersnaam en wachtwoord waarmee hij na registratie kan inloggen op de Website. Klant is zelf verantwoordelijk voor het kiezen van een voldoende betrouwbaar wachtwoord.
5.3. Klant dient zijn inloggegevens, zijn gebruikersnaam en wachtwoord strikt geheim te houden. SØSSA / Sussa Designs is niet aansprakelijk voor misbruik van de inloggegevens en mag er steeds vanuit gaan dat een Klant die zich aanmeldt op de Website ook daadwerkelijk die Klant is. Al hetgeen gebeurt via het account van Klant, valt onder de verantwoordelijkheid en het risico van Klant.
5.4. Indien Klant weet of vermoedt dat zijn inloggegevens in handen van onbevoegden zijn gekomen, dient hij zo spoedig mogelijk zijn wachtwoord te wijzigen en/of SØSSA / Sussa Designs daarvan in kennis te stellen, zodat SØSSA / Sussa Designs gepaste maatregelen kan nemen.
Artikel 6. Uitvoering Overeenkomst
6.1. Zodra de bestelling door SØSSA / Sussa Designs is ontvangen, stuurt SØSSA / Sussa Designs de producten met inachtneming van het in lid 3 van dit Artikel gestelde zo spoedig mogelijk toe.
6.2. SØSSA / Sussa Designs is gerechtigd derden in te schakelen bij het uitvoeren van de verplichtingen die voortvloeien uit de Overeenkomst.
6.3. De levertermijn bedraagt in beginsel 1-2 weken. De wijze van levering kan op verschillende manieren plaatsvinden en is ter keuze van SØSSA / Sussa Designs.
6.4. Indien SØSSA / Sussa Designs de producten niet binnen de overeengekomen termijn kan leveren, stelt zij Klant daarvan in kennis. Klant kan in dat geval akkoord gaan met een nieuwe leverdatum of hij krijgt de mogelijkheid om de Overeenkomst kosteloos te ontbinden.
6.5. SØSSA / Sussa Designs raadt Klant aan de geleverde producten te inspecteren en de daarbij gebleken gebreken binnen bekwame tijd, bij voorkeur schriftelijk, te melden. Zie nader het Artikel omtrent garantie en conformiteit.
6.6. Zodra de te leveren producten op het opgegeven afleveradres zijn afgeleverd, gaat het risico, waar het deze producten betreft, over op Klant. Indien uitdrukkelijk anders is afgesproken, gaat het risico al eerder over op Klant. Als Klant besluit de producten af te halen, gaat het risico over bij overdracht van de producten.
6.7. SØSSA / Sussa Designs is gerechtigd een soortgelijk product van soortgelijke kwaliteit te leveren zoals het bestelde product, indien het bestelde niet meer leverbaar is. Klant is dan gerechtigd de Overeenkomst kosteloos te ontbinden en het product kosteloos te retourneren.
Artikel 7. Herroepingsrecht
7.1. Dit artikel is slechts van toepassing op de Klant zijnde een natuurlijk persoon die niet handelt in de uitoefening van zijn beroep of bedrijf.
7.2. Klant heeft het recht de op afstand gesloten Overeenkomst met SØSSA / Sussa Designs binnen 14 dagen na ontvangst van het product, zonder opgave van redenen, kosteloos te ontbinden.
7.3. De termijn gaat in op de dag nadat de Klant, of een vooraf door hem aangewezen derde, die niet de vervoerder is, het product heeft ontvangen, of:
- als Klant in eenzelfde bestelling meerdere producten heeft besteld: de dag waarop Klant, of een door hem aangewezen derde, het laatste product heeft ontvangen;
- als de levering van een product bestaat uit verschillende zendingen of onderdelen: de dag waarop Klant, of een door hem aangewezen derde, de laatste zending of het laatste onderdeel heeft ontvangen;
- bij Overeenkomsten voor regelmatige levering van producten gedurende een bepaalde periode: de dag waarop Klant, of een door hem aangewezen derde, het eerste product heeft ontvangen.
7.4. Klant dient de retourkosten zelf te dragen, indien deze kosten hoger zijn dan het reguliere posttarief geeft SØSSA / Sussa Designs een raming van deze kosten. De verzendkosten die door Klant zijn gemaakt bij de aankoop van het product worden niet begrepen onder de kosten voor het retourneren en blijven voor eigen rekening van Klant.
7.5. Binnen de in lid 1 bedoelde herroepingstermijn zal Klant zorgvuldig omgaan met het product en de verpakking. Klant zal de verpakking slechts openen en het product slechts gebruiken voor zover dit nodig is om de aard, de kenmerken en de werking van producten na te gaan. Uitgangspunt hierbij is dat deze inspectie niet verder mag gaan dan dat Klant in een fysieke winkel zou kunnen.
7.6. Klant is alleen aansprakelijk voor waardevermindering van het product die het gevolg is van een manier van omgaan met het product die verder gaat dan toegestaan in het vorige lid.
7.7. Klant kan de Overeenkomst conform de in lid 1 van dit Artikel gestelde termijn ontbinden door het modelformulier voor herroeping (digitaal) te zenden aan SØSSA / Sussa Designs, of op andere ondubbelzinnige wijze aan SØSSA / Sussa Designs kenbaar te maken dat hij van de aankoop af ziet.
SØSSA / Sussa Designs bevestigt in geval van een digitale melding de ontvangst van die melding. Na ontbinding heeft Klant nog 14 dagen om het product terug te zenden. Het is ook mogelijk om binnen de in lid 1 van dit Artikel gestelde bedenktermijn het product direct terug te zenden, mits het modelformulier voor herroeping of andere ondubbelzinnige verklaring voor herroeping is bijgesloten.

7.8. Reeds door Klant (vooruit) betaalde bedragen zullen zo spoedig mogelijk, doch uiterlijk binnen 14 dagen na ontbinding van de Overeenkomst worden terugbetaald aan Klant op dezelfde wijze als dat Klant de bestelling heeft betaald. Als Klant heeft gekozen voor een duurdere methode van levering dan de goedkoopste standaardlevering, hoeft SØSSA / Sussa Designs de bijkomende kosten voor de duurdere methode niet terug te betalen. Tenzij SØSSA / Sussa Designs aanbiedt het product zelf af te halen, mag SØSSA / Sussa Designs wachten met terugbetalen tot SØSSA / Sussa Designs het product heeft ontvangen of tot Klant aantoont dat hij het product heeft teruggezonden, naar gelang welk tijdstip eerder valt.
7.9. Op de Website wordt duidelijk, tijdig voor het sluiten van de Overeenkomst informatie over het al dan niet van toepassing zijn van het herroepingsrecht en een eventuele gewenste procedure vermeld.
Artikel 8. Betaling
8.1. Klant dient betalingen aan SØSSA / Sussa Designs volgens de in de bestelprocedure en eventueel op de Website aangegeven betaalmethoden te voldoen. SØSSA / Sussa Designs is vrij in de keuze van het aanbieden van betaalmethoden en deze kunnen ook van tijd tot tijd wijzigen. In geval van betaling na levering kent Klant een betalingstermijn van 14 dagen ingaand op de dag na levering.
8.2. Indien de Klant niet tijdig aan zijn betalingsverplichting(en) voldoet, is deze, nadat hij door de SØSSA / Sussa Designs is gewezen op de te late betaling en SØSSA / Sussa Designs de Klant een termijn van 14 dagen heeft gegund om alsnog aan zijn betalingsverplichtingen te voldoen, na het uitblijven van betaling binnen deze 14-dagen-termijn, over het nog verschuldigde bedrag de wettelijke rente verschuldigd en is SØSSA / Sussa Designs gerechtigd de door hem gemaakte buitengerechtelijke incassokosten in rekening te brengen. Deze incassokosten bedragen maximaal: 15% over openstaande bedragen tot € 2.500,-; 10% over de daaropvolgende € 2.500,- en 5% over de volgende € 5.000,- met een minimum van € 40,-. SØSSA / Sussa Designs kan ten voordele van Klant afwijken van genoemde bedragen en percentages.
Artikel 9. Garantie en conformiteit
9.1. Dit artikel is slechts van toepassing indien er sprake is van een Klant die niet handelt in uitoefening van zijn beroep of bedrijf. Indien er door SØSSA / Sussa Designs een aparte garantie op de producten wordt gegeven geldt, onverminderd het zojuist gestelde, dit voor alle type Klanten.
9.2. SØSSA / Sussa Designs staat er voor in dat de producten voldoen aan de Overeenkomst, de in het aanbod vermelde specificaties, aan de redelijke eisen van deugdelijkheid en/of bruikbaarheid en de op de datum van de totstandkoming van de Overeenkomst bestaande wettelijke bepalingen en/of overheidsvoorschriften. Indien specifiek overeengekomen, staat SØSSA / Sussa Designs er tevens voor in dat het product geschikt is voor ander dan normaal gebruik.
9.3. Een door SØSSA / Sussa Designs, fabrikant of importeur verstrekte garantie doet niets af aan de wettelijke rechten en vorderingen die de Klant op grond van de Overeenkomst al heeft en kan inroepen.
9.4. Indien het afgeleverde product niet aan de Overeenkomst beantwoordt, dan dient Klant binnen een redelijke termijn nadat hij het gebrek heeft ontdekt SØSSA / Sussa Designs daarvan in kennis te stellen.
9.5. Indien SØSSA / Sussa Designs de klacht gegrond acht, worden na overleg met Klant de relevante producten hersteld, vervangen of vergoed. De maximale vergoeding is, met inachtneming van het Artikel aangaande aansprakelijkheid gelijk aan de door Klant betaalde prijs over het product.
Artikel 10. Klachtenprocedure
10.1. Indien Klant een klacht heeft over een product (conform Artikel aangaande garantie en conformiteit) en/of over andere aspecten van de dienstverlening van SØSSA / Sussa Designs, dan kan hij bij SØSSA / Sussa Designs telefonisch, per e-mail of per post een klacht indienen. Zie de contactgegevens onder aan de Algemene Voorwaarden.
10.2. SØSSA / Sussa Designs geeft Klant zo spoedig mogelijk, maar in ieder geval binnen 3 dagen na ontvangst van de klacht, een reactie op zijn klacht. Indien het nog niet mogelijk is een inhoudelijke of definitieve reactie te geven, dan zal SØSSA / Sussa Designs binnen 3 dagen na de ontvangst van de klacht, de klacht bevestigen en een indicatie geven van de termijn waarbinnen zij verwacht een inhoudelijke of definitieve reactie te geven op de klacht van Klant.
10.3. Klant die niet handelt in de uitoefening van zijn beroep of bedrijf kan ook een klacht indienen via het Europese geschillenbeslechtingsplatform, te bereiken via http://ec.europa.eu/odr/.
Artikel 11. Persoonsgegevens
11.1. SØSSA / Sussa Designs verwerkt de persoonsgegevens van Klant conform de op de Website gepubliceerde privacy statement.
Artikel 12. Slotbepalingen
12.1. Op de Overeenkomst is Nederlands recht van toepassing.
12.2. Voor zover door regels van dwingend recht niet anders wordt voorgeschreven, zullen alle geschillen die mochten ontstaan naar aanleiding van de Overeenkomst worden voorgelegd aan de bevoegde Nederlandse rechter in het arrondissement waar SØSSA / Sussa Designs gevestigd is.
12.3. Indien een bepaling in deze Algemene Voorwaarden nietig blijkt te zijn, tast dit niet de geldigheid van de gehele Algemene Voorwaarden aan. Partijen zullen in dat geval ter vervanging (een) nieuwe bepaling(en) vaststellen, waarmee zoveel als rechtens mogelijk is aan de bedoeling van de oorspronkelijke bepaling gestalte wordt gegeven.
12.4. Onder "schriftelijk" wordt in deze Algemene Voorwaarden ook communicatie per e-mail en fax verstaan, mits de identiteit van de afzender en de integriteit van de e-mail voldoende vaststaat.

Introduction
Below you will find our General Terms and Conditions. These are always applicable when you use or place an order through our Website. The General Terms and Conditions contain important information for you as a buyer. Therefore, please read them carefully. We also recommend that you save or print these conditions so that you can review them again at a later time.
Article 1. Definitions
1.1. SØSSA / Sussa Designs: located in Hoeven and registered with the Chamber of Commerce under registration number 85725048, operating under the name SØSSA / Sussa Designs.
1.2. Website: the website of SØSSA / Sussa Designs, accessible via www.sossashop.com and all associated subdomains.
1.3. Customer: the natural person who, not acting in the course of a profession or business, enters into an Agreement with SØSSA / Sussa Designs and/or has registered on the Website.
1.4. Agreement: any agreement or arrangement between SØSSA / Sussa Designs and Customer, of which the General Terms and Conditions form an integral part.
1.5. General Terms and Conditions: these present General Terms and Conditions.
Article 2. Applicable General Terms and Conditions
2.1. The General Terms and Conditions apply to all offers, Agreements, and deliveries made by SØSSA / Sussa Designs, unless expressly agreed otherwise in writing.
2.2. In the event that the Customer includes provisions or conditions in their order, confirmation, or communication of acceptance that deviate from or do not appear in the General Terms and Conditions, these shall be binding on SØSSA / Sussa Designs only if they have been expressly accepted in writing by SØSSA / Sussa Designs.
2.3. In cases where specific product or service conditions also apply alongside these General Terms and Conditions, those conditions shall also apply. However, in the event of conflicting conditions, the Customer can always invoke the provision that is most favorable to them.
Article 3. Prices and Information
3.1. All prices stated on the Website and in other materials originating from SØSSA / Sussa Designs include VAT and, unless otherwise indicated on the Website, other government-imposed levies.
3.2. If shipping costs are applicable, this will be clearly stated well before the conclusion of the Agreement. Additionally, these costs will be displayed separately during the ordering process.
3.3. The content of the Website has been compiled with the utmost care. However, SØSSA / Sussa Designs cannot guarantee that all information on the Website is at all times accurate and complete. Therefore, all prices and other information on the Website and in other materials originating from SØSSA / Sussa Designs are subject to obvious programming and typographical errors.
3.4. SØSSA / Sussa Designs cannot be held responsible for (color) deviations due to screen quality.
Article 4. Formation of the Agreement
4.1. The Agreement is concluded at the moment of acceptance by the Customer of the offer made by SØSSA / Sussa Designs and the fulfillment of the conditions set forth by SØSSA / Sussa Designs.
4.2. If the Customer has accepted the offer electronically, SØSSA / Sussa Designs promptly confirms the receipt of the acceptance of the offer electronically. As long as the receipt of this acceptance has not been confirmed, the Customer has the possibility to terminate the Agreement.
4.3. In the event that it becomes apparent that incorrect data has been provided by the Customer during the acceptance or conclusion of the Agreement, SØSSA / Sussa Designs has the right to fulfill its obligations only after the correct data has been received.
4.4. Within legal frameworks, SØSSA / Sussa Designs has the right to verify whether the Customer can fulfill their payment obligations, as well as to inquire about all facts and factors relevant to a responsible conclusion of the Agreement. If, based on this investigation, SØSSA / Sussa Designs has reasonable grounds to not enter into the Agreement, they are entitled to refuse an order or request with motivation, or to attach special conditions such as advance payment to the execution.
Article 5. Registration
5.1. To make optimal use of the Website, the Customer can register via the registration form/account sign-up option on the Website.
5.2. During the registration process, the Customer chooses a username and password with which they can log in to the Website after registration. The Customer is responsible for selecting a sufficiently secure password.
5.3. The Customer must keep their login details, username, and password strictly confidential. SØSSA / Sussa Designs is not liable for misuse of the login details and may always assume that a Customer who logs into the Website is indeed that Customer. Everything that happens through the Customer's account falls under their responsibility and risk.
5.4. If the Customer knows or suspects that their login details have fallen into unauthorized hands, they must change their password as soon as possible and/or notify SØSSA / Sussa Designs so that appropriate measures can be taken.
Article 6. Execution of the Agreement
6.1. Once the order has been received by SØSSA / Sussa Designs, the products will be sent to the Customer as soon as possible, in accordance with the provisions of Section 3 of this Article.
6.2. SØSSA / Sussa Designs is authorized to involve third parties in the fulfillment of obligations arising from the Agreement.
6.3. The delivery time is generally 1-2 weeks. The method of delivery can take place in various ways and is at the discretion of SØSSA / Sussa Designs.
6.4. If SØSSA / Sussa Designs is unable to deliver the products within the agreed period, it will inform the Customer of this. In such cases, the Customer may agree to a new delivery date or have the option to cancel the Agreement free of charge.
6.5. SØSSA / Sussa Designs recommends that the Customer inspect the delivered products and report any defects discovered within a reasonable time, preferably in writing. Refer to the Warranty and Conformity Article for further details.
6.6. Once the products to be delivered have been delivered to the specified delivery address, the risk concerning these products passes to the Customer. Unless expressly agreed otherwise, the risk passes to the Customer earlier. If the Customer decides to pick up the products, the risk transfers upon the transfer of the products.
6.7. SØSSA / Sussa Designs is entitled to deliver a similar product of similar quality to the ordered product if the ordered product is no longer available. In this case, the Customer is entitled to cancel the Agreement free of charge and return the product at no cost.
Article 7. Right of Withdrawal
7.1. This article applies only to the Customer who is a natural person and does not act in the course of their profession or business.
7.2. The Customer has the right to cancel the distance contract with SØSSA / Sussa Designs within 14 days of receiving the product, without stating reasons, free of charge.
7.3. The period starts on the day after the Customer, or a third party designated by them who is not the carrier, has received the product, or:
if the Customer has ordered several products in the same order: the day on which the Customer, or a third party designated by them, receives the last product;
if the delivery of a product consists of multiple shipments or parts: the day on which the Customer, or a third party designated by them, receives the last shipment or part;
for agreements regarding regular delivery of products during a set period: the day on which the Customer, or a third party designated by them, receives the first product.
7.4. The Customer shall bear the cost of returning the goods, provided that these costs exceed the regular postal rate; SØSSA / Sussa Designs will provide an estimate of these costs. The shipping costs incurred by the Customer when purchasing the product are not included in the costs of returning and remain the responsibility of the Customer.
7.5. Within the withdrawal period referred to in clause 1, the Customer shall handle the product and packaging with care. The Customer shall only open the packaging and use the product to the extent necessary to assess the nature, characteristics, and functioning of the product. The principle is that this inspection should not go beyond what the Customer could do in a physical store.
7.6. The Customer is only liable for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods as per the previous clause.
7.7. The Customer can cancel the Agreement within the term set out in clause 1 of this Article by sending the model withdrawal form (digitally) to SØSSA / Sussa Designs or by notifying SØSSA / Sussa Designs of their withdrawal in another unequivocal manner. In case of a digital notification, SØSSA / Sussa Designs will confirm the receipt of this notification. After withdrawal, the Customer has 14 days to return the product. It is also possible to return the product immediately within the term set out in clause 1 of this Article, provided the model withdrawal form or another unequivocal statement of withdrawal is enclosed.

7.8. Any payments made by the Customer (in advance) will be refunded as soon as possible, but no later than 14 days after the Agreement has been cancelled, in the same manner as the Customer used for the original transaction. If the Customer has chosen a more expensive method of delivery than the standard delivery offered, SØSSA / Sussa Designs is not obliged to refund the additional costs for the more expensive method. Unless SØSSA / Sussa Designs offers to collect the goods themselves, they may wait to refund until they have received the goods or until the Customer has provided evidence of returning the goods, whichever occurs earlier.
7.9. The Website provides clear and timely information about whether the right of withdrawal applies and the desired procedure before concluding the Agreement, in accordance with the provisions of clause 1.
Article 8. Payment
8.1. The Customer must make payments to SØSSA / Sussa Designs according to the payment methods indicated in the ordering process and possibly on the Website. SØSSA / Sussa Designs is free to choose the offered payment methods, which may also change from time to time. In case of payment after delivery, the Customer has a payment term of 14 days starting from the day after delivery.
8.2. If the Customer fails to fulfill their payment obligation(s) in a timely manner, they shall, after being notified by SØSSA / Sussa Designs of the late payment and after SØSSA / Sussa Designs has granted the Customer a period of 14 days to fulfill their payment obligations, be liable to pay statutory interest on the outstanding amount and SØSSA / Sussa Designs shall be entitled to charge the Customer for the extrajudicial collection costs incurred. These collection costs amount to a maximum of: 15% on outstanding amounts up to € 2,500; 10% on the subsequent € 2,500, and 5% on the next € 5,000, with a minimum of € 40. SØSSA / Sussa Designs may deviate from these amounts and percentages in favor of the Customer.
Article 9. Warranty and Conformity
9.1. This article applies only when the Customer is not acting in the course of their profession or business. If SØSSA / Sussa Designs provides a separate warranty on the products, this applies to all types of Customers, notwithstanding the previous statement.
9.2. SØSSA / Sussa Designs guarantees that the products comply with the Agreement, the specifications mentioned in the offer, the reasonable requirements of soundness and/or usability, and the legal provisions and/or government regulations that existed on the date the Agreement was concluded. If specifically agreed, SØSSA / Sussa Designs also guarantees that the product is suitable for a purpose other than normal use.
9.3. A warranty provided by SØSSA / Sussa Designs, manufacturer, or importer does not affect the legal rights and claims the Customer has and can invoke based on the Agreement.
9.4. If the delivered product does not meet the Agreement, the Customer must notify SØSSA / Sussa Designs of this within a reasonable time after discovering the defect.
9.5. If SØSSA / Sussa Designs deems the complaint to be valid, the relevant products will be repaired, replaced, or reimbursed in consultation with the Customer. The maximum compensation is, subject to the Liability Article, equal to the price paid by the Customer for the product.
Article 10. Complaints Procedure
10.1. If the Customer has a complaint about a product (in accordance with the Warranty and Conformity Article) and/or other aspects of the services provided by SØSSA / Sussa Designs, they can file a complaint with SØSSA / Sussa Designs by phone, email, or mail. See the contact information at the end of the General Terms and Conditions.
10.2. SØSSA / Sussa Designs will respond to the Customer's complaint as soon as possible, but in any case within 3 days of receiving the complaint. If it is not yet possible to provide a substantive or definitive response, SØSSA / Sussa Designs will confirm the complaint within 3 days of receiving it and provide an indication of the timeframe within which they expect to provide a substantive or definitive response to the Customer's complaint.
10.3. A Customer who is not acting in the course of their profession or business can also file a complaint through the European Online Dispute Resolution platform, which can be accessed at http://ec.europa.eu/odr/.
Article 11. Personal Data
11.1. SØSSA / Sussa Designs processes the Customer's personal data in accordance with the privacy statement published on the Website.
Article 12. Final Provisions
12.1. Dutch law applies to the Agreement.
12.2. Unless mandatory legal provisions dictate otherwise, any disputes arising from the Agreement shall be submitted to the competent Dutch court in the district where SØSSA / Sussa Designs is located.
12.3. If a provision in these General Terms and Conditions proves to be invalid, this shall not affect the validity of the entire General Terms and Conditions. In such a case, the parties shall establish (a) new provision(s) to replace the invalid provision, to the extent possible, in line with the intent of the original provision.
12.4. In these General Terms and Conditions, "in writing" also includes communication by email and fax, provided the identity of the sender and the integrity of the email are sufficiently established.

how it started, the concept and vision
Hi, I'm Noortje and welcome to SØSSA – this journey started during the corona crisis, when I felt the urge to unleash my creative side. I stumbled upon videos of people turning their old clothes into something totally different. So I thought- why not give it a shot myself?
I started small on Vinted, by simply chopping shirts and turning dresses into two-piece sets. Selling those items and hearing all the feedback was a total rush. I actually didn't even know how to sew at first, but I dove in headfirst and committed to this new adventure.
So, right now I'm learning the sewing ropes through courses, one stitch at a time. I'm also dreaming of attending a fashion program someday to gain more knowledge in pattern-making and fabrics.
For me it's not just about creating cool items; it's about doing it in a way that's good for our planet. I want to make a positive impact by reimagining old and forgotten materials into colourful, outstanding items. My brand is all about making unique pieces while keeping it eco-friendly.
